Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the services offered by Akaere Networks ("we", "us", or "our"). Your access to and use of the service is conditioned on your acceptance of and compliance with these Terms.

Use of Services

Our services include BGP, BGP tunneling, and IXP services ("Services"). By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Services.

Service Availability and Maintenance

We strive to provide the best service possible, with a 99.9% uptime goal. However, we do not guarantee that our Services will always be available or be uninterrupted. We may schedule maintenance during which the Services may be unavailable. We will make reasonable efforts to notify you of any planned downtime.

Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to use our Services:

• In any way that violates any applicable national or international law or regulation.
• For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "spam," or any other similar solicitation.
• To impersonate or attempt to impersonate Akaere Networks, a company employee, another user, or any other person or entity.
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm Akaere Networks or users of the Services or expose them to liability.

Payment Terms

Certain aspects of the Services require payment. You agree to provide accurate and complete billing information. All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you are responsible for payment of all such taxes, levies, or duties.

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Akaere Networks and its licensors. The Service is protected by copyright, trademark, and other laws of both China and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Akaere Networks.

Limitation of Liability

In no event shall Akaere Networks, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.

Indemnification

You agree to defend, indemnify and hold harmless Akaere Networks and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Services, or b) a breach of these Terms.

Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Governing Law

These Terms shall be governed and construed in accordance with the laws of China, without regard to its conflict of law provisions.
